Yahoo! wins Yahoosir.com domain name in arbitation – DomainNews

An arbitrator with the National Arbitration Forum awarded the domain name Yahoosir.com to Yahoo .The company submitted a complaint to the National Arbitration Forum on January 25,2012,asserting legal rights over the disputed domain name . Yahoo owns many trademark registrations for the "Yahoo" mark.Therefore,it is more than obvious that the domain name is confusingly similar to its trademark.Moreover,Yahoo contended that the respondent registered and used the disputed domain name in bad faith :"Respondent’s use of the disputed domain name to reroute Internet traffic to the corresponding website in an effort to make a profit demonstrates bad faith registration ""Complainant argues that the domain name generates confusion as to the relationship between Complainant’s YAHOO! mark and Respondent’s website and that Respondent makes financial gains from the pay-per-click fees generated when confused Internet users click on the displayed links. Complainant also alleges that Respondent takes advantage of the fame and status of Complainant’s mark by registering the confusingly similar domain name in order to attract Internet users to its site."The respondent failed to submit a response in this proceeding.The Panel ordered the disputed domain name to be transferred from the respondent to the complainant .
