An arbitrator with the National Arbitration Forum has awarded Forces.com domain name to John Berryhill.SalesForce.com submitted a complaint with the National Arbitration Forum on November 2,2011,asserting legal rights over the disputed domain name . SalesForce.com contended in the complaint that Forces.com domain name is confusingly similar to its "Force" and "Force.com " marks .Therefore,SalesForce contended that the respondent is guilty of typosquatting.Moreover,the company contended that the respondent ,John Berryhill ,registered and used the domain name in bad faith :"John Berryhill had actual or constructive knowledge of Complainant’s rights before the domain name was registered. Moreover, Complainant contends that Respondent is a “professional domain name seller,” has exhibited a pattern of infringement on the trademark rights of others, and has offered to sell the domain name to Complainant. "On the other hand,JOhn Berryhill contended that Salesforce.com’s mark are neither famous nor distinctive and that the domain at issue in this case is a common dictionary word .The Panel ordered the disputed domain name to remain with John Berryhill .
