An arbitrator with the WIPO Arbitration and Mediation Center has awarded the domain name NovoNordisk.xxx to Novo Nordisk. Novo Nordisk has recently filed a complaint with the WIPO Arbitration and Mediation Center,asserting legal rights over the disputed domain name NovoNordisk.XXX. According to whois records the domain name was registered on December 19,2011,few days after the ICM Registry made the .XXX extension available for public sale.Novo Nordisk owns trademark registrations for the "Novo Nordisk" mark.Therefore,it was easy for the company to demonstrate that the domain name was confusingly similar to its trademark.Moreover,the company also managed to demonstrate that the respondent registered and used the disputed domain name in bad faith and that the respondent doesn’t have rights over it.
The Panel decided the domain name to be passed over to Novo Nordisk because it falls under all three of the stipulations.
