Nokia Corporation,a multinational communications corporation is engaged in the manufacturing of mobile devices and in converging Internet and communications industries.
The company submitted a complaint to the National Arbitration Forum requesting the domain name,ovistore.com to be transferred to the respondent to the complainant.Nokia has a trademark registration with the United States Patent and Trademark Office for its "Ovi" mark, filed June 29,2007.On the other hand, the respondent, which is Nehra Corp. in this case registered the domain name August 29 2007.Moreover it seems that the respondent’s domain name resolve to a website featuring links to third party websites that offer competing products. Therefore, the respondent seems to have taken advantage from click-through fees. The Panel decided that the disputed domain name is confusingly similar to the complainant’s "Ovi" mark ,that it has no rights or legitimate interest over the domain name and finally that he registered and used the domain name in bad faith.
Therefore, they ordered the disputed domain name,ovistore.com.to be transferred from the respondent to the complainant.
