The difference between being labeled a legitimate domainer or a cybersquatter depends upon one word – trademark. If you own a domain name incorporating the trademark of another you face legal and financial exposure for cybersquatting. While defenses are available, such as fair use of a generic or merely descriptive word, that may not stop an alleged trademark owner from pursuing your domain. So what is a domainer to do? The answer lies in the problem. Develop your domain in such a way that you are entitled to trademark rights distinct from those that may be claimed by a trademark owner.

SEATTLE – The Associated Press is reporting that in a deal was reached on Monday between Microsoft and HP, where Microsoft’s Internet Search Engine will become the default search program on all personal computers sold in the United States and Canada by Hewlett-Packard, the world’s largest manufacturer of personal PCs. Microsoft’s search engine ranks a distant third after Google and Yahoo and this agreement is designed to help Microsoft get its sponsored links in front of more users starting January, 2009. Abstract: Since the early Commercialisation of the World Wide Web, cybersquatting as a phenomenon has been in existence and has been consistently rising; with recent 2006 figures showing a 25% increase up from the previous year.
This paper examines the various legal mechanisms that have been employed to deal with cybersquatting by examining firstly, the reaction of the Courts and secondly, the reaction of the registering authorities. Finally the paper looks at some of the more recent attempts to curb cybersquatting at the registration level by the employment of phased registration periods and additionally some radical solutions suggested in some circles will also be examined.

Yesterday, a misleading article was once again published by Sahar Sarid on geo domains that misinformed many people in the domain industry. Steve from SimplyDomains was intitially going to respond to his post on Sahar’s blog. However, he decided to wait things out and put my emotions aside, so he could write an informative post on geo domains based on facts and not opinions to give domainers and investors an unbiased view of geo domains that speaks volumes on its own. The domain name America.com, up for auction last week on Sedo, failed to reach its reserve price. The highest bid was US$1.71 million. It had been hoped the domain name would reach a price of between $3.5 million and $7 million.

AppleInsider is reporting that there is further evidence to support the notion that Apple will soon rebrand and overhaul .Mac, Daring Fireball and fellow technology pundits on Twitter have discovered that Me.com is now in Apple’s hands. On Saturday, records show the domain transitioned from any EasyDNS registration to MarkMonitor, a company that manages domain name services for commercial brands — including Apple and its host domain. The Web site for Iowa’s state courts system will switch to a new domain name on Aug. 1, court administrators said. The new address, www.iowacourts.gov, is simpler and shorter than the domain used now, according to a press release. The "dot-gov" domain is already used by most state agencies in Iowa.

The internet is currently unpoliced says The Guardian. And the nearest it has to a governing body is the Internet Governance Forum of stakeholders which they describe as more like a parliament than an executive. The article describes how the IGF is made up, gives its background and notes there are "[m]any countries, particularly developing nations, were unhappy that the US had so much online clout. They saw Icann, originally set up as an offshoot from the US Department of Commerce, as a tool of western colonialism. They wanted to see it administered by the United Nations in a top-down fashion."
