An arbitrator with the National arbitration Forum has awarded LizTaylor.com,LizTaylor.net and LizTaylor.org domain names to Elizabeth Taylor Trust.
The complainant owns many trademark registrations for the "Elizabeth Taylor" mark all over the world.Elizabeth Taylor was commonly reffered to be others as "Liz Taylor".Therefore,the complainant argued that the disputed domain names are confusingly similar to its trademark.
Moreover,Elizabeth Taylo Trust contended in the complaint that the respondent registered and used the disputed domain names in bad faith.The complainant provided evidence that the respondent offered to sell the domains for $2 million.
On the other hand ,the respondent contended that he assumed the "Liz Taylor" name for most of his life for his transgendered alter ego.Moreover,he contended that the domain names are not confusingly similar to complainan’t "Elizabeth Taylor" mark .
After reviewing all the facts,the Panel decided the disputed domain names to be transferred from the respondent to the complainant.
