WIPO announced that a rulling has been issued in favor of Chaenl regarding rights to the Internet domain name chanelgift.com. Chanel,represented in this case by Fross Zelnick Lehrman & Zissu filed a complaint with the WIPO Arbitration and Mediation Center,asserting legal rights to the disputed domain name.The fashion house owns many registered trademarks for the "Chanel" mark.Therefore,they contended that the disputed domain name is confusingly similar to its trademark.Moreover,they contended that the respondent registered and used the domain name in bad faith ."Respondent is or has been commonly known by the disputed domain name, and that Respondent’s only use of the disputed domain name is to “misdirect Internet traffic to competing retail and luxury goods companies and websites so that it can generate pay-per-click revenue” .Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the disputed domain name be transferred from the respondent to the complainant.
