The National Arbitration Forum announced that a ruling has been issued in favor of AOL regarding rights to the internet domain name joystuq.com . AOL,represented in this case by James R. Davis ,submitted a complaint to the National Arbitration Forum,asserting legal rights to the disputed domain name.The company has established rights in the "Joystick" mark through its mark registration with the United States Patent and Trademark Office .Therefore,they contended that the disputed domain name is confusingly similar to its trademark.Moreover,they contended that the respondent registered and used the domain name in bad faith ."Respondent is using the domain name to divert Internet users to Respondent’s website at . Such use of a domain name which is confusingly similar to Complainant’s mark disrupts Complainant’s online business and is evidence of bad faith registration and use."The Panel ordered the disputed domain name be transferred from the respondent to the complainant.
