With 48 % stake in .hotel applicant, Afilias will soon become the exclusive shareholder of HTLD. Due to claims related to Krischenowski’s action of taking advantage of an error in ICANN’s new gTLD applicants’ portal with the purpose to have access to secret financial and technical information, which pertain to competing .hotel applicants.
Being aware the way HTLD obtained rights to .hotel, the rival applicants gathered to ask it to drop its rights.
This news made Afilias chairman Philipp Grabensee to address ICANN and clarify the the type of relationship between HTLD and Krischenowski. The letter included also their denial of any benefit from the so-called error in the data.
At that time Krischenowski owned 50% and was the manager of a German company that owned 48% of HTLD.
In a letter submitted in March he was claiming that Krischenowski’s portal credentials were used more than 8 times aiming to access private data on .hotel bids.
It appears that Mr Krischenowski accessed and downloaded, at minimum, the financial projections for Despegar’s applications for .HOTEL, .HOTEIS and .HOTELES, and the technical overview for Despegar’s applications for .HOTEIS and .HOTEL. Mr Krischenowski appears to have specifically searched for terms and question types related to financial or technical portions of the application.
In his defense Krischenowski claimed he is not responsible of any malpractice, he simply used the portal thinking is working well.
In the letter was clearly mentioned that no data Krischenowski was shared to HTLD. This supposed actions have been made without HTLD’s knowledge or approval.
Although it was thought HTLD’s competing .hotel applicants assumed the reason HTLD won was due to the private data, they wanted to clarify through their lawyer the real ground. The competing .hotel applicants wanted to disqualify it based on the new gTLD program rules that don’t allow people who were sentenced by computer malpractice.
The competing .hotel applicants are Famous Four Media, Travel Reservations, Donuts, Minds + Machines and Fegistry.
It seems the investigation is not yet finished, ICANN now asking more specific details related to Krischenowski’s relationship with HTLD in the last years.
